In the lawsuit, the plaintiff, identified as Jane Doe, alleges Foxx "intentionally and without consent used force to offensively touch" her, groping her breasts and private areas at a trendy rooftop restaurant in Manhattan.

The suit was filed by attorney Craig Phemister. The plaintiff said she met an allegedly drunk Foxx at the Catch NYC rooftop in August 2015 and asked if he would take photos with her and her friend.

She claimed she was then pulled by the actor into a "secluded area," where he put his hands down her pants. When her friend came looking for her, the actor apparently walked away.

Doe was 18 at the time of the alleged incident.

The suit also names several Catch restaurant employees and its owner as defendants, and says they allowed the Oscar-winner to become intoxicated and did not provide adequate security and receive proper training to protect guests.

The woman is seeking damages and said she continues to experience pain and suffering due to the incident.

The 55-year-old actor was in the limelight this year after a near-fatal medical complication in April, when he was rushed to the hospital while filming his Netflix film Back in Action. He has not revealed the nature of his mystery health scare that kept him out of the public eye for months.

The spike in recent cases bringing sexual assault allegations to the forefront is due to the expiration of New York's Adult Survivors Act, which expires at midnight on Thursday. The law created a one-year window for alleged victims in New York to file civil suits past the statute of limitations. Similar suits have been brought in the past week against stars including Axl Rose and Sean "Diddy" Combs.
